Regulation (EU) 2022/2065 sets horizontal obligations for intermediary services offered in the EU — conduit, caching and hosting services, online platforms and marketplaces, and very large online platforms and search engines (VLOPs/VLOSEs).

What it does (at a glance)

  • Graduated due-diligence duties: notice-and-action for illegal content, statements of reasons, complaint handling, trusted flaggers, transparency reporting.
  • Extra obligations for VLOPs/VLOSEs (45M+ EU users): systemic-risk assessment and mitigation, independent audits, data access for researchers, crisis response.
  • Bans on dark patterns and on ads targeted at minors or based on sensitive data.
  • Enforcement: national Digital Services Coordinators; the Commission directly supervises VLOPs/VLOSEs.

Key dates

  • In force: 16 November 2022; fully applicable 17 February 2024.
